1. Introduction

Welcome to Diffus (“we”, “our”, “us”). This Safety Agreement (“Agreement”) outlines the terms and conditions under which users (“you”, “your”, “user”) may use our online image generation service (“Service”). By using our Service, you agree to comply with this Agreement in full. We may occasionally update this Agreement without prior notice, and by continuing to use the Service, you agree to be bound by the updated Agreement.

2. Age Requirement

You must be at least 18 years old or the age of majority in your jurisdiction, whichever is higher, to use our Service. By accessing or using our Service, you represent and warrant that you meet this age requirement. We strictly prohibit the use of our Service for the creation, dissemination, or storage of content involving minors in explicit or sexually suggestive situations.

3. User Responsibilities

3.1 Compliance with Laws: You agree to use the Service in compliance with all applicable local, state, national, and international laws and regulations, including but not limited to laws regarding the production, distribution, and possession of obscene materials and child pornography.

3.2 Prohibited Content: You agree not to use the Service to generate, upload, share, distribute, or otherwise make available any content that:

• Violates any applicable laws or regulations.
• Depicts or promotes child pornography or any form of exploitation of minors.
• Involves the likeness of a specific individual for commercial or sexual purposes without their explicit consent.
• Depicts extreme fetishes, illegal conduct, or extreme violence such as rape, sexual abuse, scat, bestiality, graphic violence, gore, animal abuse, severe injuries, or human death.
• Is obscene, defamatory, libelous, or otherwise unlawful.
• Is disrespectful, demeaning, or harmful towards people or groups of people on the basis of religion, nationality, ethnicity, race, gender, sexual orientation, disability, or medical conditions.
• Infringes upon the rights of any third party, including intellectual property rights.

3.3 Responsibility for Content: You are solely responsible for any content you generate, upload, share, or distribute using our Service. We do not censor or monitor the content generated by users, but we reserve the right to review and remove any content that violates this Agreement or applicable laws.

4. Content Moderation

4.1 Automated Content Labeling: We use Amazon Rekognition and an open-source image tagging system to automatically apply content labels and screen images for moderated content.

4.2 Community-Driven Moderation: Users can vote on the content labels applied to images, helping us refine our image classification system. We encourage users to report content violations and reward their efforts through a Guardian’s leaderboard that highlights the most helpful community members.

4.3 Manual Reviews: Certain combinations of tags or resources trigger a manual review before the content becomes publicly visible.

5. Termination of Access

We reserve the right to suspend or terminate your access to the Service without notice if we believe, in our sole discretion, that you have violated this Agreement or any applicable laws. We may also cooperate with law enforcement authorities in investigating any suspected violations.

6. Cooperation with Law Enforcement

We will cooperate fully with law enforcement authorities in investigating and prosecuting any illegal activity involving our Service. This includes, but is not limited to, providing information and content to law enforcement as required by law.

7. Reporting Violations

If you become aware of any content or activity that violates this Agreement, please report it to us immediately at safety@diffus.me. A “Report” button is available on most images and models throughout the site. Your vigilance helps us maintain a safe and respectful community.

8. Appeals Process

If you believe your content has been removed unfairly, you can submit an appeal for further review through our Appeal Form.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Limitation of Liability

To the fullest extent permitted by law, GRAVITI TECHNOLOGIES INC, DIFFUSE PTE. LTD. and their affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Service; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any content obtained from the Service; and (d) any conduct or content of any third party on the Service.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law principles. Any legal actions or proceedings arising out of or related to this Agreement shall be brought exclusively in the federal or state courts located in the United of Sates.

12. Changes to the Agreement

We reserve the right to modify this Agreement at any time. Any changes will be effective immediately upon posting the revised Agreement. Your continued use of the Service after the posting of any changes constitutes your acceptance of such changes.
